Commissioners move into executive session to discuss legal advice and real-estate negotiation

County Attorney Cynthia Mitchell asked the board to convene an executive session at the Jan. 7 meeting to receive legal advice and to develop negotiation strategy on real-estate matters.
Mitchell said she was withdrawing a separate request to discuss Black Hills for scheduling reasons and instead requested the board meet in executive session under the Colorado Open Meetings Act. She cited C.R.S. § 24-6-402(4)(b) to receive legal advice on questions about county property disposal, transfer or sale to elected officials; C.R.S. § 24-6-402(4)(e) to determine positions and develop negotiation strategy and instruct negotiators regarding the purchase of 414 West Ninth Street; and C.R.S. § 24-6-402(4)(a) to discuss the real estate purchase. Mitchell also corrected the meeting notice, saying the property address is 414 West Ninth Street (the notice had said 19th Street).
The chair asked for a motion citing the reasons Mitchell provided. A motion was made to go into executive session; the board voted in favor with three recorded "ayes." The transcript records the motion and the chair saying, "All in favor, say aye. Aye. Aye." After the vote the chair announced, "We're in executive session."
