The Nelson County Board of Supervisors voted Jan. 14 to rezone a property at 10761 Thomas Nelson Highway (known locally as the Sunny Mountain store, which houses a convenience store, Marathon gas station and the Indian Oven restaurant) from A-1 agricultural to B-1 business.
County planning staff said the businesses on the property are legally vested nonconforming uses and that rezoning would align the property’s zoning with its current commercial use and allow an increase in permitted freestanding sign area from 50 square feet (the A-1 limit) to 150 square feet under B-1 zoning. The property sits in the East District and contains flood-zone areas that will continue to restrict development per the county’s flood ordinance, staff said.
The county’s future land-use map places the property in a Lovington designation, which staff said prioritizes regional-scale development, redevelopment, and infill. The planning commission unanimously recommended approval at its December meeting, staff said.
The board opened and closed the public hearing with no speakers registered specifically for the rezoning and then approved Rezoning No. 24-0289 as presented.
