Miami Lakes board approves pool variance allowing 3‑foot rear setback with conditions

The Town of Miami Lakes Planning and Zoning Board approved a variance allowing a proposed swimming pool to be built three feet from the rear property line where the town’s Land Development Code requires a five‑foot setback.
Planning staff presented VARH2024‑0490 and recommended approval with conditions. "Approval shall be substantially consistent with the plans attached as an exhibit B as amended to reflect a minimum 3 feet setback," planning staff member Justin Telleria said, and staff also required additional landscaping as needed.
Applicant Ronnie (Rodney) Hernandez told the board the installation will remove an existing terrace roof and will not disturb neighboring properties; he said he provided neighbor support letters to satisfy the staff condition. "We are not disturbing any of the neighbors since the neighbors are to the right and to the left," Hernandez said.
Staff described the proposed pool as 28 feet by 10 feet 9 inches. The packet notes the existing rear setback of the main residence is 15.9 feet, the town’s LDC rear setback is five feet, and the applicant is proposing the pool at three feet from the rear property line. Conditions of approval included requiring the construction to be substantially consistent with the submitted plans and adding landscaping approved by planning staff.
Board members discussed the small lot sizes in that neighborhood and noted prior variances granted in similar narrow yards, but emphasized that past approvals do not automatically require approval in every case. The board voted by roll call with all members present voting yes: Alejandro Sanchez, Raul de la Sierra, Board member Julia, Vice Chair Senra and Chairman Leoncio. The motion passed and the variance was approved with the stated conditions.
