Wendell adopts personnel-policy revisions to align with drug-testing, ADA, FMLA and PWFA requirements

The Wendell Town Board of Commissioners adopted amendments to the town's personnel policy to bring policy language into alignment with current federal and state requirements regarding drug-free workplace provisions, Americans with Disabilities Act (ADA) procedures, Family and Medical Leave Act (FMLA) clarifications and the Pregnant Workers Fairness Act (PWFA).
Staff said the town engaged T. Campbell, a public human-resources law firm in North Carolina, to review existing policy language and recommend updates to ensure legal compliance. The recommended changes remove the term "substance abuse" (to avoid triggering ADA protections improperly), distinguish safety-sensitive positions (including commercial driver's-license holders) from non-safety-sensitive roles with respect to testing, and clarify who is subject to testing. The ADA section was expanded to define disability, essential functions and major life activities and to describe a process for reasonable-accommodation requests and the interactive process. The sick-leave and FMLA sections were updated to clarify the town's shared-leave program, eligible events for FMLA, certification and medical-dispute-resolution procedures. Staff also added required language for the Pregnant Workers Fairness Act.
Staff included both the proposed revised text and current policy language in the board packet. A commissioner said initial questions were answered after reviewing the full policy packet. The board approved the policy updates by voice vote.
