Planning board backs outdoor dining at Mulligan’s Lagoon mini golf on A1A

The Daytona Beach Shores Planning & Zoning Board voted to recommend approval of an outdoor dining conditional use permit for Mulligan’s Lagoon mini golf at 2504 South Atlantic Avenue, allowing six outdoor tables, a service counter and seating for 38.
City planner Gwen Hersteins told the board the application, filed Sept. 23, 2024 by owner LTGDS LLC, met 17 of the 18 criteria specific to outdoor dining conditional use permits and all five general conditional-use standards. “Staff is recommending approval of this conditional use permit based on the criteria,” Hersteins said.
The board’s discussion focused on operational limits and consistency with nearby uses. Members asked about hours and amplified sound. Hersteins said the business is open until 11 p.m. but staff and the applicant understand the outdoor dining use must end at 10 p.m. She also said live music is not approved under the outdoor-dining permit and that speakers used to address golfers have operated since the business opened; staff had not received noise complaints to date.
Hersteins explained some features were depicted on the previously approved site plan but that the conditional use permit regulates the use (outdoor dining) rather than construction: “Conditional use permits can be sought either prior to building, during the building, or in this case, after it’s built,” she said.
Board members also discussed umbrellas and signage; Hersteins said the owner removed umbrellas that contained advertising and is aware advertising on umbrellas is not permitted. The applicant and the manager were present and the board invited questions from them during the hearing.
A motion to recommend approval of CUP120-24028 as presented passed on roll call. The board’s recommendation will be transmitted to the City Commission for final action.
