Commission approves preliminary plan for Haywood Estates parcels; variance to be heard by county board

The Pennington County Planning Commission on Jan. 13 approved preliminary plan COPPL24-0014, which proposes two PCM tracts for the Haywood Estates area at 13830 Highway 40, and cleared the plan to proceed to the Board of Commissioners with six conditions.

Assistant Planning Director Jason Theneson said the property straddles the Custer–Pennington county line. The proposed PCM tract east totals 5.8 acres with 3.12 acres in Pennington County and meets current zoning; PCM tract west totals 3.0 acres with 1.52 acres in Pennington County. Because portions of the proposed tracts fall below Pennington County’s minimum lot-size standard, the applicants requested a variance to maintain the existing configuration. Theneson said the variance request will be heard by the Board of Commissioners on Jan. 21, 2025.

Staff noted several technical corrections that must be made before final plat submittal, including adding eight-foot utility and minor drainage easements, correcting certificate language, and fixing typographical errors identified by the register of deeds and the department of equalization. Theneson said those corrections will be addressed during the final plan review prior to recording.

A motion to approve the preliminary plan with six conditions carried by voice vote; the transcript records an aye but does not include a roll-call tally.

The applicants, Patrick and Kathy Mack, will submit a final plan with the required corrections; the Board of Commissioners will consider the variance and final approvals at its Jan. 21 meeting.
