Rob Hague, senior city planner in Community Planning and Development (CPD), told the council the subject parcel is approximately 42,419 square feet and currently contains an automotive dealership. Staff said the proposal would change the zoning from Urban Edge Mixed Use (MX3) with adult‑use and billboard overlays to an Urban Center Mixed Use 8‑story (CMX‑8) district without those overlays. Hague said the requested CMX‑8 district aligns with Comprehensive Plan 2040 and Blueprint Denver mapping that designate this area as an urban center or community center suited for higher‑density, mixed‑use development.
One public speaker, Jesse LaShawn Paris, spoke in opposition, citing worries about gentrification and asking what specific uses and benefits would come from rezoning. The property owner, Sam Nikui, addressed the council and said he intends to put the property on the market after retiring: "I just wanna change the zoning. So I've been there since 1998. I just retired. I'm 65. So I just wanna sell them Put it on the market." Council Member Torres said she appreciated the Sun Valley Community Coalition letter in support and noted Federal Boulevard is an appropriate place for growth consistent with the West Area Plan.
The roll call on final consideration was unanimous: the clerk announced 11 ayes and Council Bill 24‑1588 passed. Because the council voted to place the ordinance on final consideration and due pass, the rezoning will be reflected in the city's official zoning map if no further procedural steps are required.
Staff emphasized the property’s access to transit, nearby parks, and community amenities and described the rezoning as an infill opportunity intended to expand housing variety and support neighborhood centers.
