Preliminary plan for Hoop and Horn subdivision held pending title and survey issues

Mills County Commissioners Court discussed unresolved title and survey issues related to the Hoop and Horn subdivision and did not take a vote on the preliminary plan.

County staff and the court said the matter involves questions about historic road alignments and whether existing perimeter fences mark legal boundaries. The court reported that Don King, a surveyor with long experience cited by staff, flagged outstanding title and deed questions that require review by a title company or abstract, and that the county’s surveyor and engineers are working with the property owner’s representatives on the items.

Staff said Reynolds County Abstract (referenced in the meeting) and Mills County records were used to research historic minutes and deeds; staff reported they returned findings to the applicant’s surveyor. Commissioners said the preliminary plan could not be approved while title or “tile” work (title work) remained outstanding and that TxDOT access or road-right-of-way agreements might also need to be resolved.

Because the court was told the owner’s surveyor and Don King still had unresolved issues, the court did not vote to approve the preliminary plan and asked staff and the surveyor to continue working with the applicant to clear the outstanding title and boundary questions before the plan returns for a vote.
