Committee advances technical fix to juvenile-records statute

Sarah Behrens, staff attorney at the State Court Administrator’s Office, testified the bill corrects a cross-reference error in subsection 1 of section 27-20.2-23. She said the statute currently cites a provision dealing with restitution (2720.420) but should reference 27-20.4-21, the section governing transfer to other courts where transfer to adult court is implicated.
Behrens said the mis-citation likely dates back to a prior major statutory rewrite and was caught by court staff. Committee members asked whether the error was recent; Behrens replied she believed the mistake may have been in the code since the rewrite two sessions prior.
Motion and vote: Senator Lewick moved and the committee seconded a due-pass recommendation for SB 2055. On roll call the committee voted in favor and designated Senator Castaneda to carry the bill.
