The Roswell City Council approved zoning case 24‑017 on a 6‑3 roll call to allow a change to a commercial cannabis floating zone and a conditional use permit for an adult‑use retail cannabis shop at 3606 North Main St., Suite 500.
Planner staff described the request as a variance from distance requirements adjacent to an RS (rural/suburban residential) zoning district and said the property is in the C2 commercial corridor. Staff told the council that the planning commission recommended approval on Dec. 17, 2024, and that the city had received one telephone inquiry and no protests. The staff packet included conditions of approval in an appendix.
Caleb Cortez, operations manager for Nomad Cannabis, said the Roswell location would be a retail store only and not an on‑site consumption lounge. He said Nomad operates retail and manufacturing locations in other New Mexico cities and has participated in community events. "This location here in Roswell will be our 4th retail location, and it will only be a retail location," Cortez said.
During public comment and council discussion, a councilor who said they lived in the neighborhood objected to signage that had been placed at the site before local approvals. The applicant apologized, said the signs were taken down and said the company did not intend to flout local process.
On the roll call for the final motion to approve zoning case 24‑017, the council recorded the following votes: Councilor Johnson (yes), Councilor Halverson (no), Councilor Arnold (yes), Councilor Moore (no), Councilor Heldenbrand (yes), Councilor Cavan (yes), Councilor Oropesa (yes), Councilor Corn (yes), Councilor Madrigo (no). The motion passed 6 to 3.
The council did not change the staff conditions listed in the packet; staff will apply the conditions under the adopted permit.
