The Decatur City Board of Zoning Appeals approved a modification to business hours at 500 North 9th Street, granting the applicant permission to operate from 8 a.m. to 5 p.m. and imposing a 2:30 p.m. cutoff for trucks to arrive and be loaded in the yard.
Applicant Seth Huber explained the request is intended to reduce instances where trucks run past the previously allowed 4 p.m. cutoff; he said operations sometimes run a short time past 4 p.m. to "get the truck lined up" and finish unloading. In response, the board discussed an alternative schedule and a condition that trucks be in the lot by 2:30 p.m.; work to finish unloading could continue to 5 p.m. Board members stressed that the primary concern raised in written and oral comments is noise from loading/unloading and equipment.
Multiple nearby residents spoke in opposition, describing recurring noise, forklift beeping, and instances of trucks stuck in mud that generated loud engine revving and extended activity into the evening. Teresa Simon, who said she lives directly across the property, said crews were "in the lot last night till 6:30" and described continual noise; other residents said conditions have improved but remain disruptive. The board heard suggestions to change loading methods (for example, lifting beams from the top rather than dragging) and to explore equipment attachments and procedures to reduce screeching and banging.
The board voted to grant the modification with the 8 a.m.–5 p.m. hours and 2:30 p.m. truck-in cutoff. Members directed the operator to continue noise-reduction efforts, inspect stormwater inlets and address mud and tracking into the street, and asked staff to follow up on any operational changes to loading practices. The board emphasized the approved hours are not a license to extend disruptive loading activity beyond the agreed conditions; staff will monitor compliance and contact the operator if violations occur.
