Board finds lot at 13202 N. 53rd St. violated weed ordinance but notes compliance; no fine imposed

The Municipal Code Enforcement Board on Jan. 8 found that violations of the city sanitation/weed code had occurred at the vacant lot at 13202 North 53rd Street (Case No. 24-4492) but determined no fine was warranted because the property was brought into compliance before the hearing.
Code Compliance Officer Laurie Smith testified that her inspection on Nov. 26, 2024, showed overgrown grass and weeds on the vacant lot; she left a reinspection hanger and, after no change, prepared a notice of violation with a compliance date of Dec. 11, 2024. Smith submitted photographic evidence taken Dec. 6 and an affidavit of compliance; she told the board that “as of today's date, the site is now in compliance.”
A board member moved for a finding that the city proved the violation by the greater weight of evidence and that no fine should be imposed because the violation was corrected prior to the hearing. The motion was seconded and passed with no nays.
