Town legal staff presented an ordinance amending the town’s procurement code to the commission, and staff also briefed commissioners on a near-term resolution to engage actuarial services.
Town Attorney explained that current code (section 2-125) requires a formal resolution when the commission waives competitive procurement requirements. The proposed ordinance would remove the resolution formality and instead permit a waiver by motion accompanied by a public finding that the waiver is "in the best interest of the town." The attorney told commissioners the change does not alter the town’s ability to waive procurement requirements; it only eliminates the separate resolution step while preserving a public finding for the record.
Separately, staff reported that VIA Actuarial Solutions—an actuarial firm the town has used in prior years—will be presented to the commission next week by resolution to carry out standard pension actuarial work. Staff noted that some municipal codes explicitly list actuarial services as professional services eligible for procurement exceptions; Pembroke Park’s code does not, and staff recommended a broader review of procurement language after the ordinance. The commission instructed staff to bring procurement-code recommendations and comparisons with peer cities for a fuller code update.
