The Lowell Conservation Commission granted a Negative 3 determination on Jan. 3 allowing construction of a small in-ground pool at 49 Perrin Way.
Peter White of Aqua Tyme Pools told the commission the proposed kidney-shaped pool measures roughly 15 by 26 feet, with a shallow end about 3 feet deep and a deep end about 5 feet; the closest distance from the pool edge to the mapped 100-foot buffer was estimated at about 20–25 feet in one direction but overall the contractor said the pool would be approximately 100 to 120 feet from the mapped 100-foot buffer and outside the 50-foot buffer.
Commissioners asked about elevation and how the site sits relative to the protected resource; White said the house sits on higher ground and the regulated resource lies in a valley below. After discussion, Commissioner Belli moved for a Negative 3 determination; Commissioner Ciccarelli seconded and the commission voted to issue the Negative 3 determination, clearing the project to proceed through the city permitting process.
White said the pool is planned as a non-diving residential pool that wraps around an existing rear porch; he noted the deeper end is farther from the resource. The commission recorded that the project is outside the 50-foot buffer and above the wetland resource, and issued the determination without special conditions beyond routine erosion-control expectations for construction work near hill slopes.
