Planning board recommends approval to rezone Charlotte Pipe parcels to light industrial

The Indian Trail Planning Board recommended approval of ZM202531, a conventional rezoning request from Regional Business District (RBD) to Light Industrial for two parcels totaling about 13.9 acres owned by Charlotte Pipe and Foundry.
Staff told the board the request is intended “to rezone the newly purchased properties to match the owners light industrial zoning on their primary property,” and said the rezoning would align the lots with adjacent light industrial uses and the town’s future land-use map.
The rezoning is a direct rezoning (not conditional), which staff said would open the parcels to the uses allowed by right in the light industrial district. Staff noted those by-right uses include “contractor construction storage yard, equipment sales, light manufacturing, motor vehicle repair, warehousing, wholesale distribution, freight movement” and other uses listed in the code. Staff recommended approval, finding the change consistent with the comprehensive plan goals for land use, transportation coordination, and economic development.
A resident, Vic Thomas of 3405 Hayes Road, asked about a mining overlay connected historically to the brickyard on the site and whether the overlay would be removed. A staff member explained the overlay stems from a state mineral-rights excavation permit and said the property owner has been working with the state to have the permit revoked. Tyler, identified in the meeting as a senior planner, told the board the owner “was in the final stages” of getting the state permit revoked and that once the state revokes the permit the mining overlay could be removed. Planning director Brandy Dees said the effort to remove the mining rights surfaced when the property was marketed about five years ago and “it looks like they're at the very end of that process.”
Board member Jennifer Morrow moved to recommend approval “of the zoning map amendment case request ZM202531, Charlotte Pipe and Foundry, as presented.” The motion was seconded and carried on a voice vote.
Next steps: the planning board’s recommendation will go to the town council for final action. Because this is a direct rezoning (not conditional), any uses allowed in the light industrial district would be available by right if council approves the change.
