The Board of Zoning Appeals unanimously approved a variance to legalize an existing unpermitted pole-shed accessory structure at 7224 Commodore Road in the St. Paul’s area.
County staff told the board the structure encroached on the AGR zoning district’s required 30-foot rear setback and 15-foot interior side setback. The applicant and property owners, Leonard and Annie Lou Newton, said the building was on the lot when they bought the foreclosed property in 2015 and that county tax records reflected the structure as accessory for many years. Staff recommended approval with one condition: the owners must obtain all required zoning and building permits for the accessory structure.
During the hearing board members noted the structure’s long presence and the lack of complaints from neighbors. A motion to approve the variance—finding the seven required variance criteria satisfied—passed unanimously. The board instructed staff to mail the written decision within 10 working days and to assist the owners with permit requirements.
The decision legalizes the pole shed subject to the condition that the owners obtain any outstanding zoning and building permits and comply with inspection requirements.
