The Clinton County Area Plan Commission on Jan. 7 granted primary approval to a one‑lot minor subdivision petitioned by Garrett Kimmel, allowing a proposed 2.0971‑acre lot to be split from a 121.78‑acre parent tract in Perry Township.
The petition (application cc2024-01459; docket 26-24-SD) describes the proposed new lot on the east side of South County Road 450 West between West County Road 300 South and West County Road 400 South in Section 25 of Perry Township. The petitioner intends to build a single nonfarm dwelling on the new lot for personal residence.
County staff told the commission the proposed lot did not score enough points under the county’s point system and therefore required a special exception heard by the Board of Zoning Appeals on May 28, 2024. Staff said the chosen lot location was selected in part to avoid drainage issues. The new home site is within the Robert Miller Watershed.
Staff reported the surveyor’s office granted a waiver on Nov. 8, 2024 so the proposed lot would not be required to appear before the drainage board. The health department approved the lot as suitable for a septic system and indicated a perimeter drainage outlet will be required; the location for that outlet was shown on the primary plat. County Highway staff raised no objection to driveway access to the new lot. Staff also reported the recorder’s office found no other recorded instruments with the Kimmel name that would conflict with recording. The draft covenants include standard rural development protection language and an enforcement clause that staff said can be initiated by adjacent landowners within 1,320 feet.
After staff recommended primary approval, Andy Bailey moved to approve the application and Grant Mueller seconded. A roll call vote recorded yes from Grant Mueller, Dan Sheets, Walt Minnick, Andy Bailey and Jeff Chenoweth; the motion carried unanimously. Staff said the commission will review the secondary plat before final signatures; once recorded, staff said the lot will be buildable and the petitioner may begin applying for necessary building permits.
The petitioner, identified in the record as Garrett Kimmel, offered no additional comments during the hearing. No public objections were recorded in the transcript.
