Judge David D. Wolfe recused himself Wednesday from a default-motion hearing in a contractor dispute involving Gold Medal Roofing and a defendant identified as Mr. Marsh, saying he has a personal connection to the defendant that would make it inappropriate for him to preside.
The recusal came after Kaitlyn Parham, who identified herself as counsel for Gold Medal Roofing, told the court the company filed a complaint in February alleging Mr. Marsh had not answered or responded to the suit and sought a default judgment. Parham said the complaint was filed in February 2024 and that the defendant had not answered.
“I'm gonna recuse myself from this case simply because the fact that it would be inappropriate for me to hear it where he and my children were at the school together,” Judge David D. Wolfe said on the record. Wolfe told counsel he had known the defendant and that the personal relationship made it improper for him to continue.
Wolfe said the case would be reset before a different judge to allow the parties time to obtain legal advice and, if appropriate, to try to work the matter out before a new hearing. The judge offered March or April dates and advised the parties he could not provide legal advice. Kaitlyn Parham remained listed as the moving attorney on the record.
