The Jacksonville Beach Board of Adjustments approved a variance for homeowner Adam Wolf at 1013 8th Avenue North to allow construction of a swimming pool and decking that will increase lot coverage to 42% where the land development code limits coverage to 35%.
Adam Wolf, the applicant, told the board he purchased the recently built home and that the parcel’s unusual L-shaped configuration and an easement/alley arrangement constrained driveway placement. Wolf said, “We were told by the fire marshal that we had to have more driveway because of the size of our lot,” and that those requirements contributed to his need for relief from the lot-coverage limit. He described the property as new construction from the builder with a subdivided lot layout.
Board members reviewed the site map and questioned driveway access and whether neighbors objected. Wolf said neighbors had no problems and that fencing had been installed around the property. The board opened the public hearing; no members of the public spoke.
A motion to approve BOA 24-10086 was made and seconded. Board discussion characterized the lot as undersized and oddly shaped and cited the fire code constraint as a special circumstance pushing coverage above the code limit. The roll-call vote was unanimous in favor: Jennifer Williams — yes; Matt Metz — yes; John Wallen — yes; Laura Tierney — yes; Owen Curley — yes. The board announced the request was approved.
The approval authorizes the pool and associated decking to proceed under the variance. The transcript records board discussion of drainage and that pools also represent water capture, but no additional permit conditions were recorded in the hearing minutes included in the transcript.
