Final plat for Isabelle Estates phase 2 returns; staff recommends denial without MOU or road improvements

Staff recommended denial of the final plat for phase 2 of Isabelle Estates, which would add 24 lots and bring the subdivision to the 90 lots allowed under the approved concept plan, because required road improvements and requested plat revisions have not been completed.

Spencer, a planning staff member, summarized the background: Phase 1 was approved and platted for up to 66 lots (maximum allowed before certain road-improvement conditions apply). The October 2021 concept plan approved 90 lots in total but included Condition 3, which states that up to 66 lots may be platted before either the applicant installs an eastbound left-turn lane on East Emery Road at Brackett Road or future improvements providing that left-turn lane are complete. Neither required road improvement is complete, Spencer said, and the developer has not delivered the revised plat that addresses Planning's October 16 comments.

Spencer said engineering advised the developer that an MOU will be needed and that the MOU must be executed before engineering will sign the final plat; until that MOU is executed, the condition remains and the final plat cannot be approved. Staff also noted the Planning Commission can only approve, deny, or postpone with the applicant's consent; staff said the applicant has not requested postponement for this cycle. Planning recommended denial; commissioners asked staff why the developer had not made the changes, and staff said communications had been limited since the holidays and the developers had not returned to finalize an MOU.
