Council discusses upcoming PUC public input on carbon pipeline, considers applying for party status

City staff briefed the Council on an upcoming Public Utilities Commission (PUC) public input meeting for the proposed Southern Carbon Solutions carbon dioxide transmission pipeline and said the city may consider applying for party status in the PUC proceeding.
Staff said the PUC will hold a public input meeting in Aberdeen on Jan. 17 where Southern Carbon Solutions will present its proposed route. The filing timeline means parties that wish to have party status must submit applications to the PUC by Jan. 24 (staff identified Jan. 24 as the city’s "magic date" for submitting party-status applications). Staff then recommended the council hold a discussion at its Jan. 21 meeting to decide whether to apply for party status after hearing the Jan. 17 public input meeting.
City staff said the city attorney's office did not feel qualified to handle the type of regulatory proceeding before the PUC and recommended retaining local counsel if the council seeks party status; staff also said the city can participate as interested persons and submit comments even if it does not become a party.
No formal council vote on party status took place at the Jan. 6 meeting; the council planned to consider next steps after the public input meeting and to post a notice of a possible quorum so members could attend the Jan. 17 meeting.
