The Structural Pest Control Board on April 17, 2019 voted unanimously to approve proposed regulatory text implementing AB 2138's new standards for considering criminal histories in licensing. The board motion authorized a 45-day public comment period and delegated to the executive officer authority to adopt the proposed regulatory changes if no adverse comments are received; the motion also allowed technical and non-substantive edits to complete the rulemaking file.
Board staff told members the proposed changes are needed to bring the board into compliance with AB 2138, which substantially changes how agencies may consider an applicant’s criminal history when determining licensure eligibility. Staff noted proposed changes in board materials and said the Office of Administrative Law deadline for an associated filing was approaching; the board approved moving forward to meet statutory timelines.
Members voted in roll-call fashion (Darren Van Steenwyck, Dave Tamayo, Curtis Gooden and Mike Duran voted yes). The board directed staff to proceed with the public-notice process, and staff said the board must be compliant by July 1, 2020 and would work with legal counsel and the executive office to finalize materials for DPR and OAL review.
