Board hears reinstatement petition from Irene Agapitos Brzezinski; record closed, decision to follow

At a public hearing on July 26, the Structural Pest Control Board heard the reinstatement petition of Irene Agapitos Brzezinski, whose field representative license was revoked in 2009 after a default decision following criminal convictions.
Deputy Attorney General Melissa Tyner presented the petition packet as exhibit 1, which the board received into evidence. Tyner summarized the history: Brzezinski held field representative license FR 38887, which was canceled for nonrenewal and thereafter revoked after an accusation filed May 29, 2009. The accusation stemmed from convictions in 2008 for grand theft and receiving or concealing stolen property. Tyner said Brzezinski later disclosed additional convictions, including a conviction for possession of a controlled substance (Health & Safety Code section 11378) and unlawful possession of a firearm (Penal Code section 29800(a)(1)). Certified court documents and other records were included in the petition packet.
Irene Agapitos Brzezinski testified under oath and described rehabilitation steps she has taken since the convictions. She told the board she attends Narcotics Anonymous meetings "twice a week" for about three and a half years and has taken courses and programs referenced in letters submitted with the petition. She also provided additional character-reference letters that were marked as an exhibit to the hearing. Brzezinski said, "I'm asking that you guys don't define me by my past."
During cross-examination, Tyner and board members asked about Brzezinski's criminal history, completion of probation, current employment with A-1 Watkins, and continuing education on pest and termite materials. Brzezinski said she had completed required probation terms and that she studies the branch 2 and 3 pest and termite booklets. The board and counsel established that several rehabilitative program letters and certification documents were in the packet.
Presiding Administrative Law Judge David Rosenman opened and closed the record for this hearing and instructed the board that the decision will be made in executive session after deliberation. The judge told the petitioner a written decision is likely to be issued after the board's executive session and that it could be several months before she receives an outcome.
The board took no final action in public; the matter was submitted to executive session for decision.
