Board to review Summit Carbon slides after county attorney says in‑person update is optional

Summit Carbon Solutions requested a slot on next week’s agenda to give a project update to the Kossuth County Board of Supervisors. The board contacted its attorney for guidance and discussed whether to permit an in‑person presentation while litigation involving Summit Carbon is ongoing in other jurisdictions.

County Attorney Tim told the board he had reviewed the materials Summit Carbon offered (slides) and that the proposed update appeared to be a non‑substantive company presentation about project management and landowner outreach. "It’s a pretty perfunctory opportunity to come present," Tim said, and he told supervisors he had not identified a legal barrier to allowing the company to present in open session. Tim added that other counties had taken different approaches; some declined and some accepted the presentations.

Board members said they were concerned about opening the meeting to a wider public conversation that could include landowners and other citizens asking questions or making statements. One supervisor recommended reviewing the submitted slides before deciding and noted the board could treat the materials like any public submission.

The board did not take a formal vote. Supervisors agreed to review the slide deck submitted by Summit Carbon Solutions and to decide at the next meeting whether to invite the company for an in‑person update. The county attorney recommended that, if the company is allowed to present, the board manage time and keep the presentation within normal public comment/agenda limits.
