The Indian Trail Planning Board voted to recommend approval of ZM20250107, a conventional rezoning to change one parcel at 139 Business Park Drive from General Business District to Light Industrial.
Staff said the parcel and its surrounding business park have functioned as light industrial uses for roughly 30–35 years, but the zoning map shows General Business District for that lot, creating legal nonconforming status for some tenants. Planning staff presented the request as a targeted rezoning to match actual uses and reduce nonconformities that can hinder leasing and repairs.
Attorney Bridal Linz, representing Madison Capital and applicant Charles Duckett, said the proposed change would not alter the building footprint, buffers, or current operations and that outreach to nearby residents is planned for Nov. 3 to address concerns about perceived changes. The current tenant, ASSA ABLOY, performs assembly and warehousing activities, Linz said.
A nearby resident, who identified himself as Steve Meany, raised concerns about late-night semi-truck activity and asked whether code enforcement could investigate. Staff said they would follow up and that any ongoing after-hours loading could be subject to enforcement; they encouraged the resident to provide contact details so staff could investigate the source of late-night trucking.
Board member Jennifer Morrow moved to recommend approval of ZM20250107; a board member seconded. The motion carried.
Planning staff said the rezoning would allow the parcel to better market to tenants and reduce the risk that tenants would lose grandfathered rights if changes occurred. Staff noted that nearby daycare uses could become legal nonconforming if a townwide rezoning were later pursued, and that the town would analyze those impacts if it considered rezoning other parcels in the area.
