Council defers Hillyard subarea hearing; staff to pursue ordinance adoption in place of resolution

City planning staff and council discussed the Hilliard Sub Area Plan during the Oct. 20 agenda review. Staff said the matter has been noticed for an advertised hearing on Oct. 27 but, after review of the municipal code, determined the plan should be adopted by ordinance rather than by resolution. That determination changes the timeline because an ordinance requires readings and adoption steps that will extend past the Oct. 27 date.
Planning staff recommended the council open the Oct. 27 public hearing as advertised, take any public testimony, and then continue the hearing to Nov. 3 so the ordinance can proceed through first and second reading and be adopted subsequently. Staff said they had asked for suspension of rules to place the ordinance for first reading on the Oct. 27 agenda, recognizing the ordinance could not be finally adopted until the scheduled readings were complete.
Council moved to defer the resolution listed under hearings to Oct. 27 so the advertised hearing could occur. During discussion councilmembers sought clarity about what would happen to the resolution once an ordinance was used instead; staff and legal were still finalizing the exact procedural steps but described a process in which the resolution would be superseded by the ordinance if the council chose to proceed in that manner.
Motion: Councilmember moved and seconded a deferral of the resolution (hearing item) to Oct. 27. The motion passed by voice vote with members saying "aye." Staff noted the plan will be carried forward under ordinance C36744 (first-reading request) and the council could open and then continue the Oct. 27 hearing to Nov. 3 to permit public testimony and ordinance consideration.
