Erath County commissioners approve replat, preliminary plat, interlocal agreements, contract amendment, grants application, budget adjustments and payments

Erath County Commissioners Court on Sept. 8 approved a series of routine land-development items, contract amendments and budget items during a regularly scheduled session in Stephenville.

Approvals included a replat combining two lots in Mountain Lake Section 2, formal presentation approval of the preliminary plat for Comanche Moon phases 3 and 4 (Precinct 4), an amendment to an interlocal agreement with the North Texas Tollway Authority, an amendment to the Bennett real estate contract for Precinct 1 adding a right of first refusal, annual filing of sheriff and constable fees for 2026 (no change from 2025), county application for an SP22 grant for the sheriff’s office, multiple net-zero budget adjustments across departments, and payment of four payable packets totaling $356,488.83.

Land development: Mr. Gardner, the county’s land-development presenter, described the Mountain Lake item as “a pretty typical replat” in which a property owner who bought a neighboring lot wanted “to combine the 2 into 1 lot just to have some more space between them and the neighbors.” The court approved the replat after a motion by Commissioner Edwards and a second by Commissioner Buck.

Comanche Moon: The court approved the formal presentation of the preliminary plat for Comanche Moon phases 3 and 4, presented under the county’s older (2020) rules; the preliminary approval allows the developer to move forward with road construction planning and a preconstruction meeting the following day. The court approved the item on a motion by Commissioner Buck and a second by Commissioner Alberts.

Interlocal agreements and contracts: The court approved an amendment to the county’s interlocal agreement with the North Texas Tollway Authority; county staff said the agency is updating the agreement and that the amount collected per stopped transaction will increase to $6.50 under the proposed state rate change. The court also approved an amendment to the Bennett real estate contract for Precinct 1 that adds a right of first refusal if the county ever sells the property; the court described no other changes to terms.

Dublin EMS interlocal: The court approved an interlocal agreement related to emergency medical services between Dublin EMS and Erath County. One commissioner stated on the record that they would abstain from voting because of a conflict; the agreement was otherwise approved.

Fees, grants and budget items: The court voted to file sheriff and constable fees for 2026 with the state unchanged from the prior year and approved the county’s application for the SP22 grant for the sheriff’s office; staff stated the SP22 allocation for counties of Erath’s size is $350,000. The court approved a set of net-zero budget adjustments across multiple departments (road and bridge, precincts, district court, volunteer fire, EMS, IT, constable, emergency management, jail, sheriff, treasurer, tax assessor-collector, legal fees, capital projects, facilities, indigent health and county court), with detail sheets to be recorded in the minutes.

Payables and fiscal process: The court approved four payable packets totaling $356,488.83 and directed the county treasurer to disperse funds as presented by the county auditor. The judge noted a new posting rule requiring agenda materials to be posted three full business days before meetings, which has required workflow adjustments across departments and could lead to occasional special sessions to ensure timely payment of bills.

Other items: The court deemed certain AgriLife Extension Office items to have zero value for disposal; the record includes inconsistent references to “6 chairs” and later “66 office chairs” for the same agenda item. The court also considered a burn-ban update from the fire marshal and took no action, accepting the fire marshal’s recommendation not to impose a burn ban. Commissioners announced a county tire disposal event scheduled for Sept. 19 and a groundbreaking for the Erath County Joint Dispatch Center set for Sept. 15 at 1 p.m.
