ALRB outlines schedule in consolidated Wonderful Nurseries litigation

Laura Heid, chief board counsel, updated the board on two consolidated legal matters involving Wonderful Nurseries and affiliated greenhouse growers.
Heid reported that plaintiffs filed oppositions to the board’s motion to dismiss in the U.S. District Court, Eastern District of California. The board filed replies on Sept. 29 and a hearing on the motion to dismiss is scheduled for Oct. 20.
Heid also described activity in consolidated matters before the California Court of Appeal, Fifth Appellate District, giving the case numbers F088515 and F088520. The Attorney General’s Office is representing the board on those appeals; oral argument has not yet been set but Heid said parties have requested time and the court has indicated oral argument will likely be scheduled for mid-November. Heid said the board should expect further movement by the next board meeting.
No substantive board action was taken during open session on these items; Heid’s report was informational.
