Council members asked whether the city could amend the Cooper Street YMCA lease to permit the YMCA to partner with other organizations for after-hours access, and staff said the lease likely can be amended.
A council member asked: "Are we gonna be able to say we can either, amend the the lease to allow them to partner with or to allow the Bethel Saint Mark's group to have access to the facility after hours?" Staff advised that in conversations with the YMCA assistant executive director the organization already partners with others for special events and that the city retains the right to amend or cancel the lease for a legitimate public purpose.
City staff said the YMCA currently uses roughly 80 to 90 percent of the Cooper Street building and that the city can modify the lease to benefit other organizations if council directs it. Staff also committed to clarifying whether the YMCA has provided the annual reporting document specifically required by the lease and whether a local advisory board was formed as envisioned by the lease.
The council was advised that if it wants to amend the lease it should make a motion to provide direction to staff and to the city attorney, who will draft language for presentation at a noticed meeting. No formal amendment or vote occurred during the pre-agenda discussion.
