Committee approves multiple health-professions rule dockets; pharmacy temporary rule rejected

The advisory-board dockets primarily standardized rule chapter organization (legal authority, scope, licensure, practice standards, fees), removed duplicative language, and struck inactive renewal fees that the division said were duplicative of reinstatement processes and inconsistent with Idaho Code 67-26-14(9).
- Board of Chiropractic Physicians (docket 2403012401): Approved. The rewrite reorganized the chapter, adjusted continuing-education language to align with biannual licensure, clarified scope for chiropractic assistants, removed duplicative language regarding prescription drug compounding and sales, and revised several appendix advertising and ethics provisions.
What presenters said - Nikki Chopsky (Division of Occupational and Professional Licenses) presented the pharmacy and medical-related rule dockets; she outlined that many changes were intended to remove duplication with statute, consolidate definitions, and move to a standard-of-care regulatory approach in several places.
- Oren Duffin and Warren Duffin (Health Professions Bureau program directors/executive officers for Allied Health advisory boards) presented allied health dockets. They explained the consolidation of smaller single-profession boards into an Allied Health advisory board last session (House Bill 436), the public-notice process, and the rationale for fee-table edits and organization changes.

Context and next steps - Many of these dockets are “ZBR” (zero-based regulation) rewrites: the division consolidated, clarified and removed duplicative rule language after public notice and stakeholder engagement; in several dockets, fees were clarified or caps added, and inactive renewal fees were struck where the division said they duplicated reinstatement processes.
- Where the committee excepted subsections or removed a named exam (in the PA docket), those textual edits will govern the rule chapter the legislature forwards; any remaining statutory / rule mismatches were noted by staff as issues they prefer to avoid and which might be corrected in future rulemaking or by legislation.
The committee adjourned after completing the agenda and noted it would reconvene at 8:00 a.m. the following day to introduce three RSs before floor action.
