Representative John Vanderbaata (District 22) told the committee RS 32,253 would address sales of illegal vaping devices by creating a list of prohibited products and by requiring retailers to remove items from shelves after the list updates.
"This will create a list of what's illegal to sell. And that list will have to be updated monthly," Vanderbaata said. He added that after an update, "the seller will have 60 days to remove those devices or sell those devices before he gets sideways with this bill." Vanderbaata said the measure is intended to prevent retailers from selling products the U.S. Food and Drug Administration has determined are not legal to market.
Representative Veil moved to introduce the RS and several members expressed conditional support for introduction. Representative Kaler said he had received concerns and planned to read the text closely before a hearing. Representative Josh Wheeler said he wants the full hearing to address education efforts, mentioning the Millennium Fund as a possible resource for prevention programming.
The committee introduced RS 32,253 by voice vote; no roll-call tally was recorded. Vanderbaata and other members said enforcement, online sales and education are issues to be addressed at a full committee hearing.
