The special magistrate declined to impose a fine in case CE25-425 after finding the tree debris at 982 Geneva Drive had been removed by Oct. 9, 2025. The earlier magistrate order had required removal by Sept. 20, 2025, with a $25 per day fine to begin Sept. 21; a subsequent reinspection showed compliance.
Missy Acevedo, a City of Oviedo code enforcement officer, said a prior magistrate hearing on Aug. 28, 2025, found a violation for tree debris and ordered correction by Sept. 20. Acevedo told the magistrate she reinspected on Sept. 22 and found the debris moved to the curb, and then inspected again on Oct. 9 and found the property in compliance. Acevedo noted the owner had called to say she was having difficulty scheduling pickup and that household members included two disabled residents.
"It looks to me like the owner made some effort trying to clear it. So I'm going to decline to impose a fine," the special magistrate said, noting the property had been noncompliant for 19 days between Sept. 25 and Oct. 9 but that evidence showed the owner had arranged pickup or otherwise cleared the debris.
Acevedo's packet included the prior finding, certified‑mail receipts, affidavits of posting and an affidavit of compliance documenting the later correction. The magistrate declined to assess any fines under the circumstances.
