House Education Committee rejects two rule dockets and approves IDLA, vocational-rehab rule changes

BOISE, Idaho — The House Committee on Education cleared several administrative rule actions Feb. 7, rejecting two proposed dockets and approving rule changes for the Idaho Digital Learning Academy and the Division of Vocational Rehabilitation.
Matthew Reiver of the State Board of Education asked the committee to reject two posted dockets (identified in the transcript as docket numbers 80111 and 80202). Representative Harris moved to reject each docket; the committee approved both rejection motions on voice votes.
The committee then considered Docket 080401-2401, rules for the Idaho Digital Learning Academy (IDLA). Reiver summarized the primary changes as adding flexibility in assessment and accountability; specifically, the rules add a "comprehensive final project" as an alternative to a comprehensive final exam and give IDLA latitude to work with local districts on student assessment approaches. Representative Clow moved for approval; the committee approved the IDLA docket.
Next the committee considered rule changes for vocational rehabilitation services (Docket 4070101-2401). Reiver said the updates remove a universal requirement that every client receive a formal Individualized Plan for Employment (IPE) and instead give the division discretion to use the IPE tool where appropriate. The rules also provide flexibility for prioritizing employment maintenance services for clients with varying levels of disability and need. Representative Nelson moved to approve the vocational-rehab docket; the committee approved the changes.
Reiver said the vocational-rehab updates are intended to align with federal Rehabilitation Services Administration (RSA) requirements and to help the division prioritize resources for clients with the greatest need. Committee members asked questions about federal compliance and the practical meaning of removing a mandatory IPE for every participant; Reiver and agency staff said the IPE remains a tool in the toolbox but will not be an automatic requirement for every person who receives division services.
All four rule actions were resolved during the Feb. 7 hearing; the IDLA and vocational-rehab dockets were approved and will proceed in the administrative rule process.
