Committee approves DEQ hazardous-waste rule updates to maintain program primacy

McCurdy explained the chapter governs the generation, transportation, treatment, storage and disposal of hazardous waste and that incorporation maintains state program primacy so DEQ — rather than EPA — enforces the federal hazardous-waste regulations in Idaho. The docket includes updates to EPA Method 23, technical corrections related to the hazardous waste generator improvement rule and hazardous pharmaceutical rules, and clarifications to the definition of solid waste.
No written public comments were received and the Board of Environmental Quality adopted the rule on Nov. 14, 2024, McCurdy said.
Senator Harris moved to approve docket 58-0105-2401; Senator Blaylock seconded. The committee approved the docket on a voice vote. DEQ requested the committee’s approval to preserve a single, consistent rule set for regulated parties and maintain primacy under federal law.
