Senator Dan Foreman, District 6, presented RS31878, labeled the Idaho Bill of Patient Medical Rights, saying the proposal would codify patient safeguards such as informed consent, a written-consent requirement for experimental drugs and a prohibition on denying medical treatment to patients who refuse a vaccine.
Foreman said the measure “codifies the way medical patients and their families expect, want, and should be treated by healthcare providers,” and that the bill is intended to complement Idaho’s existing Idaho Health Freedom Act (Idaho Code 39-9003). He told the committee the attorney general’s office reviewed the draft and determined it does not conflict with state or U.S. constitutional provisions.
Senator Wintrow asked whether nondiscrimination language in a prior version — which had included sexual orientation and gender identity — could be restored; Foreman declined to add those categories back into the draft during the meeting.
Senator Lenny moved to send RS31878 to print; Senator Ziederfeld seconded. The committee voted to print the RS for a full hearing. No final statutory language was adopted at this meeting.
