Senate committee approves DEQ hazardous-waste rule docket incorporating federal updates

Michael McCurdy, Waste Management and Remediation Division Administrator for the Department of Environmental Quality, presented docket 58-0105-2401, the annual incorporation-by-reference of federal hazardous-waste regulations through July 1, 2024. The committee approved the docket on a voice vote.
McCurdy explained the rule updates include modifications to EPA Method 23 (an analytical method for certain compounds from stationary sources), clarifications to the hazardous-waste generator improvement rule and hazardous-waste pharmaceutical rule, and updates to the definition of solid waste. He said compliance with federal regulations is required regardless of state incorporation, but incorporation by reference provides a single, state-level rule set and helps DEQ retain primacy (state implementation authority).
McCurdy said the notice of rulemaking appeared in the Administrative Bulletin and no written comments were received; the Board of Environmental Quality adopted the rule on Nov. 14, 2024. Senator Harris moved to approve the docket; Senator Blaylock seconded. The committee approved the docket on a voice vote.
DEQ requested committee approval to maintain program primacy and said the changes were largely technical and administrative.
