Panel advances bill moving mental-health and substance-use rules into Idaho code

Senate Bill 10-24, which moves several administrative rules covering children's mental-health services, adult mental-health services and substance-use disorder services into Idaho code, was recommended to the Senate floor by the Health and Welfare Committee.
Sponsor Sen. Julie Van Orden, R-District 30, told the committee the bill transfers rule-based definitions, certification standards and eligibility and screening requirements into the relevant chapters of Idaho code. "There is not an increase or decreased services to anyone. It's just taking that part of administrative rule and applying it to the code," Van Orden said.
Van Orden described the change as a cleanup and consolidation: moving rule text into code will, she said, give the Legislature clearer oversight and allow future amendments through the statutory process rather than through rule changes.
There was no public testimony in opposition recorded in the committee transcript. Sen. Blaylock moved to send SB 10-24 to the floor with a due-pass recommendation; Sen. Delaney seconded. The motion passed by voice vote.
Committee members were told the bill will repeal the three rules when the code changes take effect on July 1 (transcript indicates the rules were scheduled to be effective July 1). The committee will take a floor vote on the bill at a subsequent session.
