Council approves release of sewer easement to clear way for food-cart pod at 1075 SE First Ave.

The Canby City Council on Feb. 5 approved a motion directing the city administrator to sign a letter releasing the city’s interest in a public sewer easement at the rear property line of 1075 Southeast First Avenue (Tax Lot 31E34C00405). The action clears an easement that staff and the applicant say is no longer needed and will allow a land-use-approved food-cart pod to proceed.
Associate Planner Apuricolo told the council the developer’s due diligence and public-works review indicated the easement is no longer necessary because the sewer line has been relocated and is now routed from the north side of the site. The food-cart pod project already has land-use approval, Apuricolo said, and the easement’s removal is a subsequent procedural step.
Eric Matthews of MArchitecture, representing the developer, attended the meeting and confirmed the project is ready to move forward pending the administrative sign-off.
Councilor Padden moved to approve the city administrator signing the release; Councilor Davis seconded. The motion passed 5-0.
Action: council approved termination of city interest in the public sewer easement along the rear property line of 1075 SE First Ave., enabling the applicant to proceed with the previously approved food-cart pod.
