Committee advances bill to prevent Medicaid from vetoing legislature's scope-of-practice decisions

House Bill 110 clarifies that when the Legislature or professional licensing boards set scope-of-practice for licensed professions, Medicaid should not use its internal policies to deny coverage for services covered for comparable providers.
Sen. Seiderfeld (District 24) told the committee the bill does not force Medicaid to create coverage for new services; rather, it prevents Medicaid rules or inaction from effectively vetoing legislative or board-authorized scope-of-practice changes. The bill requires providers to enter into written provider agreements with Medicaid and preserves the Legislature's ability to exclude services from coverage when appropriate.
The Department of Health and Welfare reviewed the bill and "has no objections," the sponsor said. The committee moved HB 110 to the floor with a do-pass recommendation by voice vote.
The sponsor said the bill mirrors policy the committee earlier approved this year in Medicaid rules on individual provider requirements and is intended to keep the Legislature in the lead role on scope-of-practice decisions while maintaining provider enrollment and written agreements.
