Representative Doug Pickett, R-District 27, introduced RS32485, which he described as a clarification of product-liability law for products used in agricultural production.
Pickett said the bill is not an immunity statute; rather it would clarify when a U.S. manufacturer or seller meets its common-law duty to warn consumers and the public about risks associated with agricultural products. The RS would preserve legal recourse for consumers who can show, using scientific evidence, that a warning was inadequate.
Committee members asked for clarification of the term “common law”; Pickett said it refers to court rulings outside of statute. A motion to introduce RS32485 passed by voice vote. The sponsor said the RS is a different variation from prior proposals and will be examined in detail at a full hearing.
