House State Affairs committee honors Boise State coach, advances bills on theater liquor, firefighter bargaining and brewery rules

The House State Affairs Committee voted to send House Concurrent Resolution 12 honoring Boise State football coach Spencer Danielson to the full House and advanced three separate legislative items: RS 32467 (a change to allow certain historic theaters to admit minors where beer and wine are served), RS 32450 (narrowing firefighter collective-bargaining topics to wages and hours), and House Bill 276 (equal treatment rules for out-of-state small brewers).

The measure honoring Boise State and its coach led the meeting after Representative Barbara Ehart introduced the resolution and invited Coach Spencer Danielson to speak. Coach Danielson told the committee, “This isn't just a job. This is a calling, to develop people, to develop young men.” He described Boise State as a community institution, noted “we had 7 games, 7 sellouts,” and thanked state and local supporters for their role with the program. Representative Crane moved to send the resolution to the floor with a “do pass” recommendation; the committee voice-voted the motion carried.

The committee then introduced RS 32467. Representative Clough said the measure would remove language that currently requires a building to have been built originally as a theater in order for a movie theater in a registered historic building to serve beer and wine and admit minors. “If movie theater has a beer and wine license and they are in an historic registered building, registered in the historic national register, that could sell beer and wine and allow minors to come to the movies too,” Clough said. Representative Akiles moved to introduce RS 32,467; the committee voted to introduce the measure.

Representative Rob Bieswanger introduced RS 32450, which he said would narrow the topics subject to firefighters’ collective bargaining to wages and hours. “Current law says that firefighters can negotiate over wages, rates, all kinds of terms of employment,” Bieswanger said. “This would narrow the scope down to just wages and hours.” Committee members asked how the change would affect working conditions such as staffing, station assignments and protocols; Representative Bieswanger said those operational decisions would be left to fire chiefs and elected officials. Representative Scott moved to introduce RS 32,450 with a drafting change that specifically struck “working conditions”; the committee voted to introduce the RS.

Finally, Representative Vito Barbieri presented House Bill 276, which he said aims to address a legal challenge by changing state requirements so out-of-state small brewers (those producing under 30,000 barrels) with a physical warehouse or brewery in the state would be treated the same as in-state small brewers and be subject to inspections and state regulation. “Small brewers, anyone under 30,000 barrel production will be treated the same if they are able to have a warehouse or a brewery physically located in the state,” Barbieri said. Representative Akiles moved to send HB 276 to the floor with a due-pass recommendation; the committee voice-voted the motion carried.

Procedural business at the start of the meeting included approval of the minutes from Friday, Feb. 21; Representative Akiles moved to approve the minutes and the committee approved them by voice vote.
