Committee approves joining TWARN mutual-aid agreement after indemnity clause removed

The Transportation & Infrastructure Committee on Wednesday approved a mutual-aid and assistance agreement between the Metropolitan Government of Nashville and Davidson County and participating public and private utilities under the statewide Water and Wastewater Agency Response Network (TWARN).
Mary Peoples, Metro Water Services council liaison, said the agreement formalizes the city’s ability to request and provide assistance during emergencies and that the draft agreement was edited to remove an indemnity clause. "It’s currently in place, but what they had to do was make one modification and take the indemnity clause out," Peoples said. She said the city can request or supply assistance and that the city generally receives cost reimbursement for services provided.
Peoples listed typical assistance as including "food and shelter, communication or other status information that they need, licenses and permits, or otherwise personnel included." When asked whether removing the indemnity clause increased direct liability to the city, legal staff said they would research the question and report back before the next meeting.
The committee approved the resolution on the consent calendar by an 8-0 vote.
