Sen. Julie VanOrden presented RS32269, a measure she said was drafted by the Idaho Water Users Association Legislative Committee to clarify process for methodology changes used in conjunctive management of surface water and groundwater.
VanOrden said the bill would require the director to hold a hearing on methodology changes "when a methodology change is being made" if a hearing is requested, and would specify that such an order shall take effect on Dec. 1. She said the change aims to avoid last-minute methodology orders that create disruption for farmers and growers who must plan seeding and planting operations.
"A methodology change could not be made after that," VanOrden said, explaining the December effective date is intended to give water users certainty in time to make crop and seeding decisions.
A motion to send RS32269 to print was moved, seconded and approved by voice vote with no recorded opposition on the transcript.
The draft would not itself specify particular methodologies; instead it would set procedural safeguards (hearing if requested) and a firm effective date of Dec. 1 for methodology orders under the conjunctive management rules the director uses to determine material injury.
