Representative Van der Rotta said HB 161 modernizes several aspects of Idaho’s flood control district statutes. Among the changes the bill allows a flood control district to maintain an office outside its statutory boundaries if commercial property is more practical; it permits districts to meet "as needed" rather than on a monthly schedule provided they post notice; it requires compliance with open-meeting laws; it aligns procurement for districts with current procurement statutes; and it allows flood control districts to set board member compensation similar to irrigation districts.
Committee members asked where the districts receive funding, and an attorney representing Flood Control District 10, Dan Steenson of Sawtooth Law, explained that flood control districts are taxing districts funded through levies on land within their boundaries. The committee recorded no extended debate on policy trade-offs in committee testimony.
Senator Taylor moved to send HB 161 to the floor with a due-pass recommendation; Senator Cook seconded. The motion carried by voice vote; Senator Taylor noted a reservation on his vote for later floor consideration.
The bill makes administrative and governance changes intended to provide greater flexibility to flood control districts, while maintaining open-meeting and procurement transparency.
