Committee approves bill to limit Medicaid’s role in defining provider scope of practice

House Bill 110, sponsored by Sen. Seiderfeld, passed the committee after the sponsor said it would ensure the Legislature and licensing boards, not Medicaid rulemaking, set provider scope of practice and that the bill does not require Medicaid to cover newly authorized services.
Sen. Seiderfeld (District 24) told the Senate Health and Welfare Committee that House Bill 110 is intended to ensure that scope-of-practice decisions remain the prerogative of the Legislature and professional licensing boards rather than being indirectly controlled by Medicaid policy. "This does not mean Medicaid has to cover new services, just that Medicaid is no longer in the position of vetoing legislative decisions through inaction," Seiderfeld said.
The bill requires providers to continue to enter written provider agreements with Medicaid and preserves the Legislature’s authority to exclude services from Medicaid coverage when appropriate, Seiderfeld said. The Department of Health and Welfare reviewed the bill and reported no objections.
Senators moved and seconded the bill for a do-pass recommendation. The committee approved the motion and sent HB 110 to the floor.
