Committee advances bill to move child-support license-suspension exemptions from IDAPA rule into statute; removes TANF exemption

Senator Brandon Shippey (District 9) presented Senate Bill 1051 to the Senate Health and Welfare Committee, explaining the bill would move an existing good-cause exemption (listed as section 302 in committee materials) from an IDAPA administrative rule into statute and remove TANF recipients from the list of exemptions that prevent suspension of a driver's or occupational license for nonpayment of child support.

"This bill moves section 302 from IDAPA, rule 6, 16.03.03, child support services, from administrative rule into statute," Senator Shippey said. He told the committee the provision is rarely used — "applies to less than 0.1% of all good cause exemptions in 2024" — and that other exemptions for disability, illness, student status, incarceration, and Supplemental Security Income would remain.

Senator Shippey characterized the bill as consistent with a wider legislative trend this session to move rule language into statute. He said he had consulted with the Department of Health and Welfare and that the provision had appeared before the legislature previously.

Senator Harris moved the committee recommendation to send SB 1051 to the Senate floor with a due-pass recommendation; Senator Keiser seconded. The motion was approved by voice vote; no opposition was recorded in the transcript.
