Representative Jaren Crane, R‑Nampa, asked the House State Affairs Committee on Thursday to introduce RS 32,052, a request to draft legislation that Crane said had been revised after talks with trial lawyers and an association representing dairymen.
Crane told the committee the changes were intended to narrow when law enforcement could use the proposed enforcement authority. “They wanted to make sure ... a crime was committed, so we have tighter language there,” Crane said, explaining the bill would require an investigation or detention for an independent crime under Title 18, Idaho Code.
Crane said he and his cosponsor, Representative Scogg, met with the trial‑lawyer group and the Dairymen’s Association and had made “friendly amendments” on matters they raised. He said one suggested change — to tie Idaho’s bill to a Texas Senate bill currently before the U.S. Supreme Court — would not be adopted. “We think we have a better bill ... so we’re going to stand on our own and not attach to them,” Crane said.
Committee members pressed Crane on whether the bill would differentiate infractions and crimes. Crane said a retired attorney who is a cosponsor would “do a deep dive” during a full hearing to explain how the bill distinguishes a crime from an infraction and that the draft “uses the word crime consistently.”
Representative Alfieri moved to introduce RS 32,052. The committee approved the motion by voice vote; no roll‑call vote was recorded in the hearing transcript.
The request will move to printing and a subsequent hearing where the cosponsor and legal counsel are expected to provide detailed statutory language and a fuller legal analysis.
