Committee agrees to print RS31856, a proposal to limit public-health-district authority

The Senate Health and Welfare Committee voted to print RS31856, a legislative request that would impose new limits and accountability on Idaho’s public health districts.

Senator Brian Lenny, District 13, representing Nampa, told the committee RS31856 is a response to lessons learned during the COVID-19 pandemic and aims to “tighten the rein on our public health districts” and add “a layer of accountability” to prevent what he characterized as government overreach. He also said the measure would “ensure that any health action taken is backed by solid … science and truly necessary.”

The proposal drew a follow-up question from Senator Wintrow about consultation with local health boards and how terms such as “broad” or “arbitrary” actions would be defined in statute. Lenny said those details were best addressed in a full hearing and that the goal of the draft is to narrow an existing statute that currently allows public health districts to “do all things.”

Senator Harris moved to send RS31856 to print; the motion was seconded and approved by voice vote with no recorded opposition.

The committee did not hold a full evidentiary hearing on the measure at this session; Senator Lenny said he would present additional detail when RS31856 is scheduled for a formal hearing. The print action means the language will be prepared and the bill will be filed for future committee consideration.
