“...this legislation would make administrative rules and policies more transparent for citizens and legislatures,” Representative Scott said when presenting RS 32328. The sponsor added language at a committee member's request specifying that agency policy statements and guidance shall not have the force and effect of law “pursuant to section 607-5207A” as shown in the draft before the committee.
Representative Mickelson moved to introduce the RS, noting the sponsor had worked with the committee. The committee voted to introduce RS 32328 by voice vote.
The measure aims to increase public access and clarity by centralizing agency policy statements on agency websites and requiring yearly review, and the sponsor included a statutory disclaimer to reduce confusion about binding effect. The RS is at the introduction stage and is expected to return for further consideration after drafting and review.
