Seth Hobbs, rules review officer for the Idaho Department of Parks and Recreation (IDPR), told the committee the pending rule — docket 26-0137-2401 — would repeal a chapter that duplicated testing standards for off-highway-vehicle (OHV) noise abatement.
“The Society of Automotive Engineers testing standards that are being used are covered in Idaho Code 67-7125,” Hobbs said; by removing the redundant chapter, law enforcement agencies would have a single location to find testing instructions.
Hobbs said negotiated rulemaking was conducted, notice published in the Idaho Administrative Bulletin (Volume 204-8 dated 08/07/2024), and IDPR received no opposition during rulemaking public hearings. Committee members asked whether the action repealed the entire rule chapter; Hobbs confirmed the repeal is comprehensive.
A motion to approve the rule docket passed on a voice vote; the transcript records “ayes have it” with no roll-call tally included.
